A bereaved teenager who had sex with two 15-year-old girls at a party held to “cheer him up” has been sentenced to 120 hours’ community service.
According to a recently-published Royal Court judgement, the boy – aged 17 at the time and identified only as ‘Z’ for legal reasons – had been thrown a party by his friends in order to raise his spirits following the death of a relative.
Although the party-goers were mostly aged 15 to 17, alcohol was freely available. Z’s girlfriend – known as Victim 1 – said that the pair were both drunk and had sex using a condom which she provided, but he later “complained that it was uncomfortable” and they continued to have unprotected intercourse. She then left the party accompanied home by a friend.
Upset by what had happened, Victim 1 later confided in an adult, prompting a Police investigation.
During their inquiries, it emerged that Z had also had unprotected sex with a second girl on the same night – Victim 2, who was apparently so heavily intoxicated that evening that she believed Z to be a different boy.
Victim 2 initially denied the incident, but later made a rape complaint to the Police. Z refuted this, however, accusing her of instead sexually assaulting him and stating that he had been “set up”.
In handing down his judgement, Deputy Bailiff Tim Le Cocq, who sat alongside Jurats Crill and Christensen MBE, criticised the defendant’s “opportunism” regarding the second offence, given that, “…the girl in question was very drunk indeed and there is no suggestion of an ongoing relationship”, as well as his apparent lack of remorse and attempts to cover up the truth.
Nonetheless, acknowledgement was given for Z’s youth, previous good character and, “…extremely difficult circumstances that [he] had faced personally in recent years and in particular around the time of offending" after the death of his relative.
A restrictive order was also placed on the defendant for five years, stopping him from being able to have any direct or indirect contact with Victim 2. Z will now remain on the Sex Offenders register for a period of five years, as well as serving an 18-month Probation Order.
