1) the sum of £5,358.63 claimed in respect outstanding Class 1 Social Security
contributions comprised of (1) £1,686.99 arising for reference D2023, and (2)
£3,681.64 arising for reference A2024;

2) statutory interest on any outstanding balance in accordance with Practice Direction
PD 05/3 from today to the date of payment;

3) the fixed costs in accordance with Practice Direction PD 18/01;

4) interest on such costs in accordance with Practice Direction PD 05/4 from today to
the date of payment;

and AUTHORISED the Plaintiff to have the personal of the Defendant arrested and sold,
providing that no sale shall take place without the Court's permission, unless the Viscount is
satisfied that the Defendant is aware that the goods have been arrested;

and AUTHORISED the Plaintiff to have the property of the Defendant arrested and sold,
providing that no sale shall take place without the Court's permission, unless the Viscount is

The Defendant having been represented by Mr Nick Le Cornu and having been advised that the
sum of £6,086.00 claimed in respect of compensation for unfair dismissal and wrongful
dismissal, had been received by the Plaintiff on 01st October 2024, the Court ORDERED the
Defendant to pay to the Plaintiff:

1) the fixed costs of £370.00 being comprised of (1) the Court Fee of £130.00 and (2)
standard fixed costs of £240.00 in accordance with Practice Direction PD 18/01;

2) interest on such costs in accordance with Practice Direction PD 05/4 from today to
the date of payment;

and AUTHORISED the Plaintiff to have the property of the Defendant arrested and sold,
providing that no sale shall take place without the Court's permission, unless the Viscount is

DEFENDANT

WHEREAS (1) on 5th April 2024, the Plaintiff actioned the Defendant for the sum of £9,095.34
in respect of alleged undeclared earnings and hours paid but not worked whilst the Defendant
was employed by the Plaintiff.

(2) On 17th April 2024, the Defendant having appeared to contest the claim, the case was
referred to mediation. On 2nd May 2024, the parties failed to settle the dispute at mediation
and the Court set a timetable for the filing of Pleadings.

(3) On 12th June 2024, the parties having filed and exchanged Pleadings, the Court made
further directions to progress the case to trial and set a date for the hearing to take place.

(4) On 25th September 2024, having heard from the Plaintiff through its representative and the
Defendant personally, the Court reserved its judgment and adjourned the case until 9th
October 2024.

(5) On 1st October 2024, the Court handed down its decision in favour of the Defendant,
dismissing the Plaintiff's claim and inviting the parties to make any submissions for ancillary
orders including costs.

NOW TODAY, 9th October 2024, the Court ORDERED the Plaintiff to pay to the Defendant:

1) The sum of £2,000.00 representing the fixed costs of these proceedings, comprising:
(a) £400.00 for preparing a Pleading, (b) £400.00 for providing a sworn Affidavit, (c)
£600.00 for trial preparation and (d) £600 for attending the trial, in accordance with
Practice Direction PD 18/01;

2) interest on such costs in accordance with Practice Direction PD 05/4 from today to
the date of payment;

and AUTHORISED the Defendant to have the personal property of the Plaintiff arrested and
sold, providing that no sale shall take place without the Court's permission, unless the Viscount
is satisfied that the Plaintiff is aware that the goods have been arrested.
