A 26-year-old man who kicked his father over because his dinner plate was too hot has been put on probation for a year.

The Magistrate’s Court heard that Lewis Herrick’s father needed stitches to his head after the dispute in their home on 24 November.

Crown Advocate Carla Carvalho, prosecuting, said Herrick (26) complained of burning his fingers on the hot plate on which his meal was served, and picked up a bottle and threw it in frustration before putting his dinner in the bin.

Herrick’s father told him to calm down, but Advocate Carvalho said: “The defendant kicked him in the chest and caused him to fall backwards, cutting his head.

“An ambulance was called. He needed two stitches to his head.”

Herrick admitted the charge of assault, but said he had just “lifted his leg”.

Advocate Ian Jones, defending, said his client would abide by a probation order.

Relief Magistrate David Le Cornu imposed the probation order and restraining order.
